2. Client Responsibilities

As our client, you agree to:

• Provide accurate and complete information necessary for service execution

• Cooperate in a timely manner, including approvals and feedback

• Maintain access to any platforms or accounts we are contracted to manage

• Adhere to deadlines and payment schedules

Failure to provide necessary input or access may delay the project and affect performance outcomes.

3. Payment Terms

All payments must be made in accordance with your signed agreement or invoice. Desire Driven Media accepts payments via credit card, bank transfer, or other approved methods.

• Due Dates: Invoices are due upon receipt unless otherwise stated.

• Late Fees: Invoices not paid within 10 business days may incur a late fee of 5% per month.

• Non-refundable Services: Due to the customized nature of digital services, all payments are non-refundable once work has commenced unless otherwise stated in your agreement.

4. Cancellation and Termination

You may cancel services at any time by providing written notice. However, any fees for services rendered up to the cancellation date remain payable.

In such cases, all work will cease, and remaining balances will become due immediately.

5. Intellectual Property

All content, code, designs, graphics, and materials created by Desire Driven Media remain the property of Desire Driven Media until full payment is received.

Upon full payment:

• Clients retain rights to final deliverables as outlined in their agreement

• Desire Driven Media retains the right to showcase work in our portfolio unless a written NDA is in place

You may not reuse, modify, or redistribute our materials without permission.

6. Disclaimer of Guarantees

Desire Driven Media does not guarantee specific outcomes, such as page-one rankings, specific lead volumes, or sales increases, as these depend on multiple variables including market conditions and client involvement.

We do, however, guarantee to provide services using industry best practices, transparency, and dedication to your campaign’s success.

7. Limitation of Liability

Desire Driven Media shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our website or services. Our maximum liability in any circumstance shall not exceed the total amount paid by the client in the 30 days preceding the claim.

8. Confidentiality

We respect your privacy and agree not to disclose confidential client information to third parties without your written permission, unless legally obligated to do so. Likewise, you agree not to disclose proprietary processes or pricing information provided by us.

9. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. We will notify clients of significant changes by posting an updated version on our website. Continued use of our services implies agreement to the revised terms.
